1. Acceptance of Terms
By accessing or using acadirectplans.com (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms constitute a legally binding agreement between you and ACA Direct Plans.
2. Description of Service
ACA Direct Plans is an independent advertising and marketing referral service that connects consumers with licensed health insurance agents and brokers who can discuss, present, and enroll consumers in health insurance products.
ACA Direct Plans is not an insurance company. ACA Direct Plans is not a licensed insurance broker or agent. ACA Direct Plans is not affiliated with the U.S. government, the Centers for Medicare & Medicaid Services (CMS), HealthCare.gov, the Health Insurance Marketplace, or any state Marketplace or government agency.
We do not provide insurance quotes, underwrite insurance policies, determine eligibility for any insurance product or government subsidy, calculate subsidies, or make coverage decisions.
3. No Insurance Advice; No Guarantee of Coverage
Nothing on this Site constitutes insurance, legal, financial, or tax advice. The information provided on this Site is for general informational and advertising purposes only.
ACA Direct Plans does not determine your eligibility for any insurance product, does not guarantee that you will qualify for any particular plan, and does not guarantee any specific premium, subsidy, or coverage outcome. Eligibility for ACA Marketplace coverage, premium tax credits, cost-sharing reductions, and Medicaid is determined exclusively by HealthCare.gov, your state-based Marketplace, your state Medicaid agency, or the applicable insurance carrier based on your application and supporting documentation.
Coverage options, plan availability, premiums, and benefits vary by state, county, age, household income, household size, tobacco use, and other factors. Not all licensed agents, plans, or carriers operate in all areas.
4. Eligibility to Use
You must be at least 18 years old and a resident of the United States to use this Site. By using the Site, you represent and warrant that you meet these eligibility requirements.
5. User Responsibilities
You agree to provide accurate and complete information when using our Site, including when completing the qualifying form. You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law
- Submit false, misleading, or fraudulent information
- Interfere with or disrupt the operation of the Site
- Attempt to gain unauthorized access to any portion of the Site
- Use any automated means to access or scrape the Site without our express written permission
- Impersonate any person or entity

By submitting information through our qualifying form, you expressly consent to be contacted by ACA Direct Plans and its licensed health insurance agent partners by phone, text message (including SMS/MMS), and email regarding health insurance options, including ACA Marketplace plans, Medicare, Medicaid, and other coverage products.
You agree to be contacted at the phone number and email you provided, even if your number is on a state or federal Do Not Call registry. You understand that calls and texts may be made using automated technology, including prerecorded messages and artificial intelligence. You understand that your consent is not a condition of purchase of any goods or services. Message and data rates may apply.
You may opt out of text messages at any time by replying STOP. You may opt out of phone calls by requesting removal during any call.
7. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the overall design and layout ("Content"), is the property of ACA Direct Plans or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
The ACA Direct Plans name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ACA Direct Plans. You may not use these marks without our prior written permission.
You may view, download, and print Content from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Content without our express written consent.
8. Third-Party Partners and Links
The Site connects you with third-party licensed health insurance agents, brokers, and agencies ("Agent Partners"). The Site may also contain links to third-party websites, including HealthCare.gov and Medicare.gov.
ACA Direct Plans is not responsible for the conduct, services, advice, products, content, or privacy practices of any Agent Partners or other third parties. Your interactions with Agent Partners are solely between you and the Agent Partner. Any claims, disputes, or issues arising from your interactions with an Agent Partner should be directed to that Agent Partner.
We do not endorse, guarantee, or assume responsibility for any product or service offered by any third party.
9. Disclaimers
THE SITE AND ALL CONTENT, SERVICES, AND FEATURES AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, ACA DIRECT PLANS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
ACA DIRECT PLANS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACA DIRECT PLANS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:
- Your access to or use of, or inability to access or use, the Site
- Any conduct or content of any third party on or related to the Site
- Any interactions, transactions, or disputes with Agent Partners or other third parties
- Any errors, omissions, or inaccuracies in any Content
- Any unauthorized access to or use of our servers and/or personal information stored therein
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF ACA DIRECT PLANS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Indemnification
You agree to indemnify, defend, and hold harmless ACA Direct Plans and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Site
- Your violation of these Terms
- Your violation of any rights of a third party
- Your submission of false, misleading, or fraudulent information
12. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or your use of the Site shall be resolved exclusively through final and binding individual arbitration administered by a mutually agreed-upon arbitration provider, in accordance with its applicable rules and procedures.
Class Action Waiver: YOU AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR OTHERWISE, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST ACA DIRECT PLANS. YOU ALSO WAIVE ANY RIGHT TO BRING CLAIMS AS A PRIVATE ATTORNEY GENERAL OR IN ANY OTHER REPRESENTATIVE CAPACITY.
Opt-Out: You may opt out of this arbitration agreement and class action waiver by emailing ACA Direct Plans at info@acadirectplans.com within 30 days of first accepting these Terms. Your opt-out notice must include your name and a clear statement that you do not wish to resolve disputes through arbitration.
Exceptions: Notwithstanding the foregoing, either party may bring an individual action in small claims court or seek injunctive or other equitable relief in a court of competent jurisdiction for matters related to intellectual property rights.
Survival: This arbitration provision shall survive termination of these Terms.
13. Governing Law
These Terms and any disputes arising out of or relating to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of [STATE OF INCORPORATION], without regard to its conflict of law principles.
14. Changes to Terms
ACA Direct Plans reserves the right to modify or update these Terms at any time, in its sole discretion. We will post the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.
